Sorry, not approved...

I guess you should write:
    this.applyConstraint( 'xpath', cons, this._t != null ? this._t() : [] );
Reason:
    This is just to maintain the current behaviour, in SWF 
"LzNode#applyConstraint(..)" gets called even if "this._t" is undefined.

And, you need perform this check also for the second if-condition 
(constrained "xpath" on a datapath object).
